Conditions of Use

Article 1: Acceptance of the General Conditions of Sale

The fact of filling a purchase order on and confirming this order stands for full acceptance of these general conditions of sale.

Article 2: Conclusion of the sale contract

The sale is concluded according to French laws pertaining to long distance selling, as soon as the purchase order is validated. The system of automatic recording of the purchase order is regarded as proof of the nature of the agreement and its date.

As soon as the order is received, and after validation of the payment, the order is deemed accepted by Mélissambre®. Mélissambre® then sends to the purchaser a confirmation by e-mail, indicating the selling price and the transport charges. In the same manner, Mélissambre® notifies the customer by e-mail in the event of refusal of acceptance of an order.

Article 3: General obligations of the parties

3.1 Obligations of Mélissambre®

3.11 Handling of the orders

Mélissambre® pledges in the event of an acceptance of an order, to sell and deliver to the customer the articles ordered.

For some orders, an additional time might be necessary. The customer will be notified and will keep all liberty to confirm, modify or cancel the order.

3.12 Availability

The articles presented on the site are normally available and the site is updated after each sale.

If for any reason, an article considered available could not be delivered to the customer, the paid amount would be completely refunded to him, without him being able to claim any compensation.

3.13 Product information

Due to the nature of the raw material, wood, the samples presented are given only as an indication. Those, like the photographs illustrating the products, are not deemed contractual. 

3.2 Obligations of the purchaser

In addition to the payment of his order, the purchaser must provide the necessary information necessary to the delivery and in particular an address to which the delivery can be made during business hours.

Article 4: Price, invoice

4.1 Price

The total price indicated in the confirmation of order by Mélissambre® is the final price. This price includes the cost of the articles, the packaging costs and the shipping costs.

For France, the prices are all inclusive of tax.

For the countries of the European Union, the Value Added Tax (VAT) is included in the price of the products, in agreement with the European accords. No custom duty and no additional VAT will be charged.

For the rest of the world, the VAT and other custom duties and shipping costs can be added to the price indicated on and remain the responsibility of the recipient.

4.2 Invoice

An invoice is provided for each order.

4.3 Terms of payment

Payment can be made online, by check or credit card (Visa, Mastercard, American Express) and offline by check, bank transfer, or by credit card, by phone or fax.

The payment by credit card online is secure and insured by the banking establishment BNP Paribas [Solution Merc@net de] recognized for its reliability in regards to internet transactions. The transaction, which is done between you and the servers of BNP Paribas is encrypted (SSL-128 bits). The banking information you give, encrypted on your own computer, will never circulate openly on the internet. No credit card number is stored, neither at Mélissambre® nor at its internet host.

Article 5: Shipping, delivery

5.1 Delivery periods

The delivery periods are not contractual. As an indication, they are generally 48 to 72 hours within France.

5.2 Transfer of the risks 

The transfer of the risks on the products takes place as of the handing-over of the products by Mélissambre® to the shipper (insurance cost included). They are insured during the shipping and until the delivery to the recipient, but travel to the risk of the customer.

5.3 Reserves

We recommend that the customer unpacks and checks the merchandise in presence of the shipper in order to report any possible damage. The customer can recant only in the event that the delivery is not in conformity with the order, or in the event of damage. In this case, the delivery form must be annotated and the delivery refused.

Any refusal of delivery must be announced by email or by postal mail to MELISSAMBRE E.I.

Article 6: Reserve of property

The delivered articles remain the property of Mélissambre® until their payment is completed (law N. 80-335 of May 12, 1980)

Article 7: Time of retraction

In accordance with the provisions of article L.121-16 of the French Consumer Code, the customer has, as of the time of delivery, a period of seven working days to return the products for exchange or refund. In this case, shipping costs are the responsibility of the customer. The article must be returned in its original packaging. The article can be replaced or refunded, according to the choice of the customer. Refunding minus the actual shipping costs will take place within 30 days. In the event of exchange for one or more items, if the difference in price is in favor of Mélissambre®, it will be charged to the customer’s credit card, before the new shipping. If the difference in price is in favor of the customer, Mélissambre® will refund the difference within 30 days.

Article 8: Force majeure

Neither Mélissambre® nor the customer can be held responsible for any inexecution of the contract due to a cause beyond control, including but not limited to, war, earthquake, etc.

Article 9: Attribution of competence

In the event of possible dispute on the interpretation or the execution of these conditions and after the failure of any attempt to reach an amiable solution, competence is conferred to the French courts, particularly with those on which MELISSAMBRE E.I depends.

Article 10: Royalties on the site

The entire content (images and text) of the site is the exclusive property of MELISSAMBRE E.I. You may not reproduce, transmit, publish, plagiarize, modify, archive, retain, display, distribute, or create works derived from this site.

Mélissambre® is a trademark. Its entire production is protected by patents and copyrights (art. L.521-3 to 521-7).


All the pages of this site are protected by French legislation on royalties and databases. No reproduction of this document, even partial, other than those delineated in article L 122-5 of the Code of Intellectual Property can be done without express authorization of the author.
